Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Skill Sage AI ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Deployed Intelligence ("we," "us," or "our"), the developer of Skill Sage AI.

These Terms should be read together with our Privacy Policy, which is incorporated herein by reference.

2. Description of Service

Skill Sage AI is an AI-powered skill development application that provides:

• AI coaching and personalized practice guidance
• Practice session tracking and logging
• Progress insights and analytics
• Curated learning resource discovery
• Skill goal setting and management
• Practice scheduling and calendar integration

3. Eligibility

Skill Sage AI is rated 4+ and is suitable for all ages. Users under 18 should have their parent or guardian's permission to use the App and make any in-app purchases. Parents and guardians are responsible for supervising minors' use of the App and any subscription purchases made through their Apple ID account.

4. Free Trial and Subscription

4.1 Free Trial

New users receive a 7-day free trial with full access to all Skill Sage AI features, including:

• Unlimited skill goals
• Unlimited AI coaching messages
• Unlimited practice session logging
• Unlimited insights and analytics
• Unlimited resource curation
• Smart practice scheduling and calendar integration
• 1,000,000 token allowance

The free trial is available to new users only. No payment is required during the trial period. After 7 days, a Pro subscription is required to continue using the app.

After the free trial ends, the Pro subscription continues full access to all features:

Pro Monthly: $6.99 per month

Prices are in US dollars and may vary by region based on local App Store pricing. The applicable price will be shown in the App before you subscribe.

4.5 Managing Your Subscription

You can manage or cancel your subscription at any time through your Apple ID Account Settings:

• Open Settings on your iPhone
• Tap your name at the top
• Tap Subscriptions
• Select Skill Sage AI
• Tap Cancel Subscription

Cancelling stops future charges but does not refund the current billing period. You retain Pro access until the end of the current paid period.

4.6 Restoring Purchases

If you reinstall the App or switch devices, you can restore your active subscription by tapping "Restore Purchases" in the subscription screen. Your Apple ID must be signed in on the device.

4.7 Refunds

All purchases are processed by Apple through the App Store. We do not have the ability to issue refunds directly. To request a refund, please visit reportaproblem.apple.com or contact Apple Support.

4.8 Price Changes

We reserve the right to change subscription pricing. If we change the price, Apple will notify you before the change takes effect and you will have the opportunity to cancel before being charged the new price.

5. Apple End User License Agreement

Your use of the App is also governed by Apple's standard End User License Agreement (EULA), which is incorporated into these Terms by reference and available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

As required by Apple, you acknowledge that:

• These Terms are between you and Deployed Intelligence, not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any claims related to the App
• Apple and its subsidiaries are third-party beneficiaries of these Terms

6. AI Coaching Disclaimer

By using the AI coaching feature, you acknowledge and agree that:

• AI coaching is for informational and motivational purposes only
• Suggestions may not be suitable for your specific situation, skill level, or physical condition
• We make no guarantees about skill improvement or specific results
• The AI may occasionally produce inaccurate, incomplete, or outdated information
• You should consult qualified professionals for skills where proper technique is critical, especially physical activities where injury is possible
• We are not responsible for any injury, loss, or damage resulting from following AI coaching suggestions
• The AI coach is powered by Anthropic's Claude API and is subject to their usage policies
• AI responses are generated automatically and have not been reviewed by a human

7. Token Allowance

The App uses a token system to measure AI coaching usage. Tokens are consumed when you send messages to or receive responses from the AI coach.

• Free trial includes 1,000,000 tokens for the 7-day trial period
• Pro subscription includes 1,000,000 tokens per monthly billing period
• Unused tokens do not roll over to the next billing period
• If you reach your token limit before the end of the billing period, AI coaching will be temporarily unavailable until your next billing period
• We reserve the right to adjust token allowances with reasonable notice

8. Acceptable Use

By using Skill Sage AI, you agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or hack the App
• Use automated scripts, bots, or other tools to abuse the AI coaching feature or consume tokens artificially
• Submit harmful, offensive, abusive, or inappropriate content through the AI chat
• Attempt to manipulate, "jailbreak," or circumvent the AI coaching system's guidelines
• Share your account or subscription access with others
• Use the App in any way that could damage, disable, or impair our servers or services
• Violate any applicable local, state, national, or international laws or regulations
• Reproduce, duplicate, copy, sell, or exploit any portion of the App without our express written permission

We reserve the right to terminate access for any violation of these terms without notice or refund.

9. Intellectual Property

The App, including all content, features, design, code, graphics, logos, and interfaces, is owned by Deployed Intelligence and protected by applicable intellectual property laws including copyright, trademark, and patent laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes in accordance with these Terms.

You may not:

• Copy, modify, distribute, or create derivative works based on the App
• Use our name, trademarks, logos, or brand elements without written permission
• Remove any copyright, trademark, or proprietary notices from the App
• Use the App for commercial purposes without our express written permission

10. Your Content

You retain full ownership of content you create within the App, including practice logs, skill goals, session notes, and personal data. This content is stored locally on your device and is not accessible to us.

By using the AI coaching feature, you grant us a limited license to transmit your messages to Anthropic's Claude API solely for the purpose of generating coaching responses. We do not claim ownership of your personal content and do not store it on our servers.

You are solely responsible for the content you submit through the App and represent that it does not violate any third-party rights or applicable laws.

11. Third-Party Services

11.1 Anthropic Claude API

The AI coaching feature is powered by Anthropic's Claude API. By using the AI coach, your messages are processed by Anthropic in accordance with their privacy policy and terms of service, available at anthropic.com/legal/privacy. We are not responsible for Anthropic's data practices or service availability.

11.2 Apple Services

Subscriptions are processed through Apple's In-App Purchase system. Calendar integration uses Apple's EventKit framework. Sign in with Apple is used for authentication. These services are subject to Apple's terms and privacy policies.

11.3 Learning Resources

The App may suggest or link to third-party learning resources including courses, tutorials, articles, and videos. We do not endorse, control, or take responsibility for any third-party content, products, or services. Accessing third-party resources is at your own risk and subject to their respective terms of service.

12. Privacy

Your privacy matters to us. Our Privacy Policy describes how we handle your information and is incorporated into these Terms by reference. By using the App, you agree to the collection and use of information as described in our Privacy Policy.

13. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We specifically disclaim any warranty that:

• The App will be uninterrupted, timely, secure, or error-free
• AI coaching will be accurate, complete, or suitable for your needs
• Results from using the App will meet your expectations
• Any errors or defects will be corrected
• The App or its servers are free of viruses or harmful components

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEPLOYED INTELLIGENCE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, revenue, goodwill, or other intangible losses
• Physical injury or property damage resulting from following AI coaching advice
• Unauthorized access to or alteration of your data
• Any damages exceeding the total amount you paid us in the 12 months preceding the claim
• Any matter beyond our reasonable control

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless Deployed Intelligence and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of or inability to use the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit through the App

16. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, including for violation of these Terms.

Upon termination:

• Your right to use the App immediately ceases
• Your Pro subscription will not be automatically refunded (contact Apple at reportaproblem.apple.com for refund requests)
• Data stored locally on your device remains until you delete the App

You may also terminate your use of the App at any time by deleting it from your device and cancelling any active subscriptions.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you through the App or by email where required by law

Your continued use of the App after changes become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App and cancel any active subscription.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the App shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in King County, Washington, except that either party may seek injunctive or equitable relief in court for intellectual property violations or urgent matters.

If you are a consumer in the European Union, you may have rights under applicable EU consumer protection laws that supersede certain provisions of these Terms.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and Apple's standard EULA, constitute the entire agreement between you and Deployed Intelligence regarding your use of Skill Sage AI and supersede all prior or contemporaneous agreements, representations, and understandings.
